City Property Available for Sale

On September 13, 2021, the City Council adopted Ordinance 68-O-21, Amending City Code Section 1-17-4-2 “Sale of Real Property". The ordinance requires that the notice of intent to sell a city-owned property, as a result of a negotiated sale, must be: (1) published on the City’s website as well as in a daily or weekly newspaper in general circulation in the City.

The City Code requires approval of two ordinances by the City Council for the sale of City owned property when said sale is to take place by negotiation.

  1. The first authorizes the negotiated sale of the property and identifies the person that will negotiate on behalf of the City.
  2. The second is considered after the negotiations have occurred and a negotiated price has been established.

Adoption of both ordinances require a two-thirds (2/3) vote of the elected Councilmembers then holding office.   

The ordinance requires advertisement of the negotiated sale of the property after the City Council adopts the first ordinance, authorizing the negotiated sale of the property and establishing the person to negotiate on behalf of the City, but prior to the second ordinance authorizing the actual sale of the property
